Frequently Asked Questions (FAQs) – Dangerous Drug & Pharmaceutical Injury Claims
How do I know if my drug caused my injury?
Timing is key – injuries appearing after starting a medication may be related. Oftentimes, injuries and severe conditions such as cancer caused by medication may not manifest or appear until much further down the road. We work directly with our team of nurses, experienced pharmaceutical attorneys, and medical experts to establish causation through differential diagnosis, ruling out other causes.
What if I’m still taking the medication?
Never stop taking prescribed medication without consulting your doctor. We can pursue your case while you transition to safer alternatives under proper medical supervision.
Can I join a class action lawsuit?
Most pharmaceutical cases are individual claims within multi-district litigation (MDL), not class actions. This allows personalized damage recovery based on your specific injuries, not a one-size-fits-all settlement. We have decades of experience in leadership positions in these MDLs and can help guide you through this process to obtain the compensation you deserve.
What if the drugs were FDA-approved?
FDA approval doesn’t necessarily protect drug companies from liability for your medical injuries. Many dangerous drugs were approved based on incomplete data or fraudulent submissions that were later revealed in litigation.
What if my doctor prescribed it off-label?
Off-label prescribing is legal, but pharmaceutical companies illegally marketing for off-label uses can be held liable. We will investigate whether improper marketing influenced your prescription and identify all responsible parties for your injuries.
Will this affect my relationship with my doctor?
Your lawsuit is against the drug manufacturer, not your physician. Most doctors support patients seeking compensation for injuries from drugs they prescribed based on incomplete safety information and approvals based on incomplete or fraudulent submissions.

Louisiana and National Product Recall Information
Product recall is often tantamount to an admission that a dangerous defect exists. However, recalls don’t prevent lawsuits necessary to recover compensation you deserve for a severe injury caused by a defective product. Recalls can strengthen your products liability cases by providing key evidence that the manufacturer knew, or should have known, about the defect—mainly when your injuries occurred before the recall was issued and sales continued after dangers were discovered. We also have experience challenging inadequate recalls and holding companies accountable for delayed recall implementation to protect profits.
Our defective product injury attorneys check and investigate recalls daily for the Louisiana families injured by failed products.
You can contact us anytime if a recalled product has injured you, or if you want to know more information on whether a product you use at home has been recalled. You can also check these resources for consumer product recalls and drug and medical device red flags:

Frequently Asked Questions (FAQs) – Louisiana Defective Products Injuries
How do I prove the product was defective?
Through expert engineering analysis, testing, recall details, and comparison to safety standards. We work with top experts who can demonstrate how and why the product failed, often finding safer design alternatives that would have prevented severe injury.
What if I partially modified or misused the product?
Louisiana’s comparative fault law allows recovery even with some partial fault. Manufacturers must anticipate foreseeable use of the product even if it differs from the intended use. We show how proper design would prevent injury despite minor modifications or slight misuse by the injured consumer or purchaser.
Can I sue if the product had warnings?
Yes. Warnings must be complete, adequate, visible, and understandable. Many warnings are legally insufficient. We prove manufacturers knew of greater dangers than disclosed or that warnings couldn’t eliminate unreasonable dangers.
What if my hometown Louisiana store where I bought the product is now closed?
We pursue all parties in the distribution chain – from the initial manufacturer, to the distributor, to the seller and retailer. Even if the seller is gone, manufacturers and their insurers remain liable for defective products they put in commerce, which severely injures you or a loved one here in Louisiana.
Do I need to keep the defective product?
YES. Product preservation is critical in cases involving severe injuries resulting from a defective product. Store it safely, don’t attempt repairs or modifications, and photograph it thoroughly. We’ll arrange proper storage and expert examination. Destroying or losing the product can negatively impact your future case.
What makes Neblett, Beard & Arsenault your top choice for defective products injuries?
National and statewide experience recovering hundreds of millions for our injured clients, networks of experts necessary for technical product testing, and the resources required to fight manufacturers and large corporations who spend millions to prevent recovery by injured victims. We have a 40+ year track record leveling the playing field against these corporate defendants.
Serving defective product victims throughout Louisiana: Alexandria, Pineville, Shreveport, Monroe, Baton Rouge, Lafayette, Opelousas, Lake Charles, New Orleans, and nationwide through multi-plaintiff litigation.
Industry-specific experience: Offshore equipment failures, refinery explosions, agricultural machinery accidents, industrial workplace injuries, consumer product hazards, automotive defects, and medical device failures throughout Louisiana’s industrial corridor and the Gulf South region.
We’re Here to Help Fight For Your Rights – Award-Winning Louisiana Mesothelioma Injury Lawyers
Click here to find out more about the problem with Mesothelioma in Louisiana.Mesothelioma is a vicious and deadly cancer affecting the lining—or mesothelium—of the lungs, stomach, or heart. It is caused by exposure to asbestos and can take many years after being exposed to asbestos to develop.
A diagnosis of mesothelioma is devastating. With no cure and costly treatments to extend the sufferer’s life and ease his pain, this disease not only affects the victim, but his family as well. Even though we have known for decades what causes this horrible disease, little has been done to prevent it and an average of 10 new cases are diagnosed every day across America.
What can you do if this deadly disease has become your new reality?
First, learn all you can about the disease. We have created a library of resources on our website to help you learn more about mesothelioma and lung cancer due to asbestos exposure. This information will help you find the medical care you will need to extend your life and ease your suffering. Next, talk to a lawyer with experience in these cases to pursue compensation for your medical bills and your family’s financial future.
Types Of Mesothelioma
Mesothelioma is typed by location and the kind of cancer cells that are found. Almost all mesothelioma tumors are malignant. Benign tumors are extremely rare but can be treated successfully.
The terms you are likely to hear when you are diagnosed include the following:
- Pleural Mesothelioma – Accounting for 80 percent of all new cases, the disease affecting the lining of the lungs is the most common form of mesothelioma. Symptoms often aren’t noticeable until the late stages of the disease, making the survival rate after diagnosis very poor.
- Peritoneal Mesothelioma – Originating in the lining of the stomach, this disease often spreads to the liver, spleen, and bowels. The main symptom is severe abdominal pain. The prognosis is also poor, but recent treatment developments have been made.
- Pericardial Mesothelioma – Cancer of the lining of the heart is extremely rare—affecting less than 1 percent of mesothelioma patients—and is often not diagnosed until after death.
- Epithelioid Mesothelioma – This cancer cell type is the most common, found in 75 percent of all diagnosed mesothelioma cases. Of all of the cell types, it is the most responsive to treatment.
- Sarcomatoid Mesothelioma – Accounting for only 10 percent of diagnosed cases, these cancer cells grow out of muscle and bone and are extremely difficult to treat.
- Biphasic Mesothelioma – Approximately 40 percent of patients have a mix of epithelioid and sarcomatoid cells, known as biphasic disease.
Treatment for Mesothelioma
There is no cure for this form of cancer, but aggressive treatment can extend a patient’s lifespan and ease some of the pain and discomfort associated with the disease. Your treatment plan will depend on the location of the cancer and how much it has spread, but most patients will endure some combination of the following:
- Surgery – Removing the tumors may be possible in the early stages of the disease. This may include removing the mesothelial lining and all or part of an affected organ, such as a lung.
- Chemotherapy – To kill cells that cannot be surgically removed, chemotherapy is often utilized. These drugs attack the fast-growing cancer cells.
- Radiation – Radiation therapy can be used to shrink tumors to make them easier to surgically remove.
- Complementary Treatments – While not cures for mesothelioma, there are alternative treatments that can ease a patient’s suffering and improve their mental health including acupuncture, nutritional supplements, aromatherapy, touch therapy, meditation, and music therapy.
Causes of Mesothelioma
The primary cause of mesothelioma is exposure to asbestos. Asbestos is one of several naturally occurring fibrous minerals that is heat- and fire-resistant and was used in construction materials, insulation, and household products for many years. When the microscopic fibers are released, they can be inhaled and become lodged in the delicate linings of major organs, causing cancer. People are exposed to asbestos in the following ways:
- Manufacturing products containing asbestos. While the danger of asbestos has been known for decades, it has been used in hundreds of products including adhesives, millboard, automotive materials, cement products, plasters, electrical materials, flooring, roofing, and protective clothing. Anyone working in industries that manufactured these products may have been exposed to asbestos.
- Working with products containing asbestos. Construction workers, shipbuilders, oil refinery workers, automotive assemblers, and members of the military may have worked with materials containing asbestos, exposing themselves to the deadly fibers.
- Working in environments with exposed asbestos. Renovating or demolishing old buildings often releases asbestos that has been safely contained for many years. Recently, it was discovered that workers replacing cables with fiber optic cables for telecommunications companies were exposed to asbestos when dust was released from the protective pipes.
- Using household products containing asbestos. For many years, household products incorporated asbestos because of its heat-resistant properties. It is possible that people could be exposed to asbestos by using these products, particularly if they are in disrepair or are inhaled: slow cookers, hair dryers, baby powder, cigarette filters, attic insulation, and ironing board covers.
- Living with someone who brings fibers home on his clothing. Secondary exposure to asbestos is a major cause of mesothelioma. Cases of the wives and children of workers in high-exposure industries developing the disease are not uncommon.
When a diagnosis of mesothelioma is received, it is vital that a connection be made to the exposure event. At Neblett, Beard & Arsenault, our dedicated attorneys will conduct the necessary research to determine the origin of the asbestos exposure.
Jobs That Have Been Linked to Asbestos Exposure
Workers in particular industries were exposed to high levels of asbestos and have been diagnosed with mesothelioma in greater numbers than other workers. The following jobs have seen higher than average levels of mortality from mesothelioma:
- Shipbuilding
- Petroleum refining
- Chemical production
- Electric power plant workers
- U.S. Navy service members
- Construction workers
- Insulation production and installation
- Pipefitters
- Electricians
- Machinists
Although these jobs have proven to be among the most dangerous for asbestos exposure, many other industries exposed workers to the deadly fibers throughout the 20th century.
Prognosis for Mesothelioma Patients
Unfortunately, the prognosis for most mesothelioma patients is very poor. Because of the long period—often decades—between exposure to asbestos and symptoms of the disease, it is often diagnosed in the very late stages. Most patients only live a year after diagnosis. While treatments may extend a patient’s life, there is no cure.
Mesothelioma Lawsuit Information
If you have been diagnosed with mesothelioma, you are entitled to recover compensation for your losses, but you will need legal assistance to fight for what you deserve. Damages that can be recovered include the following:
- Medical expenses
- Lost wages
- Pain and suffering
- Wrongful death
The value of your damages will be determined by examining evidence of how the disease has affected your life, your family, and your livelihood. Medical records proving the extent and seriousness of the disease will also be examined. A mesothelioma attorney from Neblett, Beard & Arsenault has experience arguing these cases and will fight to get you the maximum possible settlement for your losses by exploring the following options:
- Settling with the company liable for your damages.
- Accessing a mesothelioma trust fund if your employer is now bankrupt.

Louisiana's mesothelioma problem

Natural Disasters and Mesothelioma
Any discussion about asbestos exposure in Louisiana must include a discussion of Hurricane Katrina, one of the deadliest and costliest hurricanes in United States history. According to the Government Accountability Office, the hurricane pulled numerous industrial and consumer toxins into the water supply, and during the demolition of damaged buildings, dangerous chemicals, including asbestos, were released into the air. Many Louisiana residents were exposed to these toxins during and in the months and years after the storm, and some of those residents are experiencing adverse health effects now, according to an article in the Journal of Health Care for the Poor and Underserved.
Frequently Asked Questions (FAQs)- Mesothelioma & Asbestos in Louisiana
1. Is mesothelioma more common in Louisiana than in other states?
Somewhat. According to the Mesothelioma Applied Research Foundation, citing a study performed by the National Center for Health Statistics between 1999 and 2005, Louisiana ranks 18th in the United States for mesothelioma and asbestosis deaths.
2. What is it about Louisiana that can expose more people to asbestos?
There are a few factors at play in Louisiana that put individuals at a heightened risk of being exposed to asbestos. One is the shipping industry’s role as a major employer in the state. Ships generally contain large amounts of asbestos, and workers may be exposed to it while aboard.
Furthermore, asbestos exposure was more likely for some after Hurricane Katrina; the report from the U.S. Government Accountability Office asserts that “many thousands of homes being demolished … are generally not subject to EPA’s asbestos emission standards aimed at limiting releases of fibers into the air.” Those in areas most heavily affected could, in fact, be exposed to asbestos released into the air due to the destruction and renovation of homes as a result of the devastating hurricane.
3. What are some historic mesothelioma cases in Louisiana?
Examples of prominent mesothelioma cases in Louisiana include:
- Mabile v. Dow Chemical. Sidney Mabile, a former electrician at Dow Chemical in Baton Rouge, was awarded $5.95 million after he proved that he suffered from mesothelioma because of exposure to asbestos on the job, despite the company knowing the risks and predicting that a percentage of its employees would develop cancer.
- Morvant v. Asbestos Corporation Limited. Not all mesothelioma victims worked directly with asbestos, as this case demonstrates. Mary Morvant was diagnosed with mesothelioma after being exposed to powder asbestos on her father’s work clothing during his three-decade career with Johns Manville, a manufacturer of construction products with a plant in New Orleans. She was awarded $6.4 million for her damages.

Over forty years fighting for injured victims in Louisiana. Thousands of lives changed. Here’s what matters the most – our clients’ thoughts about our relentless advocacy:
My experience here was the best. I chose an out-of-town attorney who felt I would not win my case, and gave up on us. If you have second thoughts about Mike Koch, don’t do it. He’s the best as soon as we sat in his office he assess all paperwork pictures of our case and immediately said we can win. From that day forward, he became not only our attorney, but family his heart went out to us. Losing our father was the worst thing ever, especially how he was taken away from us was devastating. He never gave up on us and always gave his full undivided attention. It could be late night or early morning I would think of something about the case and text him. I never expect a return text because it was after hours and he would probably respond back during business hours, but to my surprise I got a response. I’ll look into it tomorrow great find or we would text back-and-forth. He always thought about us and called to make sure we were OK, and didn’t need anything. He didn’t have to do that but he did. Even after the case is over he still check on us and make sure we’re OK. Mike Koch would forever be my attorney/ family …..
